Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Marothon mobile app and website (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Marothon is operated by Lukas Haselwood, an individual based in Kansas, United States (“we,” “us”). These Terms are an agreement between you and Lukas Haselwood.
The Service
Marothon is a personal TV and movie tracking app that lets you log what you watch, build watchlists, and track your progress. You can also choose to follow other people and share a profile with them. We may add, change, or remove features over time.
Your account
- You must provide a valid email address and are responsible for keeping it accurate.
- You are responsible for activity that happens under your account and for keeping your access to your account secure.
- You must be at least 13 years old to use the Service. If you are in the European Union, you must be at least 16, unless the country you live in sets a lower age of consent for online services, in which case that age applies, and it is never below 13.
- You may not create an account to impersonate someone else, or use one after we have terminated it.
Acceptable use
There is no tolerance for objectionable content or abusive users. When using the Service, you agree not to:
- Harass, bully, threaten, stalk, or intimidate anyone, or encourage other people to do so.
- Post or upload content that is hateful or that attacks or demeans people on the basis of race, ethnicity, national origin, religion, disability, age, sex, gender identity, or sexual orientation.
- Post or upload sexually explicit content, or any sexual content involving minors.
- Post or upload graphic violence, gore, or content that glorifies violence.
- Encourage or glorify self-harm, suicide, or eating disorders, or target anyone with that material.
- Impersonate another person, or use a display name, username, or profile photo that misrepresents who you are.
- Send spam, run scams, or use the Service to advertise or solicit.
- Post or upload content you do not have the right to use, or that infringes anyone’s copyright, trademark, privacy, or other rights.
- Share other people’s personal information without their permission.
- Break the law, or use the Service to plan or carry out anything illegal.
- Attempt to disrupt, overload, reverse engineer, scrape, or gain unauthorized access to the Service or its systems, or to another person’s account.
- Evade a block, a suspension, or a termination, including by creating a new account.
Our Community Guidelines explain these rules in more detail and are part of these Terms.
Your content
You retain ownership of the content you create in the Service, such as your watch history, lists, display name, and any profile photo you upload. You grant us the limited license needed to store your content, to display it to you and to the people you have chosen to share it with, and to review it for safety as described below. That license ends when you delete the content or your account, except for copies we are required to keep as described in our Privacy Policy.
You are responsible for the content you upload, and you confirm you have the right to use it.
Followers and other people
Following on Marothon is one-way: you can follow someone without them following you back. What other people can see depends on the visibility you choose for your account, and you can change it at any time in the app.
- You choose who follows you. Unless your account is set to public, someone has to ask and you have to approve them before they can see your watch history, your statistics, or who you follow. Your username, display name, and profile photo are visible to anyone who can find you either way. Approval gates the rest of your profile, not your existence.
- You can block anyone. Blocking removes any follow between you in both directions and stops them seeing your profile or asking again.
- You can leave. You can remove a follower, stop following someone, turn the social features off entirely, or delete your account, all from the app’s Settings.
Our Privacy Policy sets out exactly which parts of your profile are visible to anyone and which are held back until you approve someone.
Reporting and enforcement
You can report a person or a profile photo from inside the app. Filing a report automatically blocks the person you reported, so you are protected immediately and do not have to wait for us to review it. We aim to review every report within 24 hours.
Profile photos are checked automatically before they are shown to anyone else, and a photo that fails that check is never published.
When someone breaks these Terms we may, depending on what happened and whether it has happened before, remove the content, remove a profile photo, reset a display name or username, limit access to features, suspend the account, or terminate it. Serious cases, including anything involving the sexual exploitation of minors or a credible threat of violence, result in immediate termination and may be reported to law enforcement. We may also act where we reasonably believe an account creates risk or legal exposure for us or for other people.

Catalog data and third parties
Catalog information such as titles, posters, and episode data is provided by The Movie Database (TMDB). This product uses the TMDB API but is not endorsed or certified by TMDB. The Service also relies on third-party providers, including Supabase, Expo, and Amazon Web Services, to operate. Your use of the Service is also subject to those providers’ terms where applicable.
App store terms
If you installed Marothon from the Apple App Store, your use of the app is also covered by Apple’s Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where that agreement and these Terms conflict on the subject matter it covers, it controls; these Terms govern everything else, including the conduct rules above. Apple is not responsible for the Service or for providing support for it. If you installed Marothon from Google Play, Google Play’s terms apply in the same way.
Privacy
Our Privacy Policy explains how we handle your information. By using the Service, you also agree to the Privacy Policy.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that catalog data will always be accurate or complete. We do not control what other people post, and we do not warrant that our review of reports or of profile photos will catch everything.
Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service, including anything arising from the conduct of another user.
Your rights as a consumer
Nothing in these Terms takes away rights you have under the consumer-protection law of the country you live in, where that law says those rights cannot be excluded. If you are a consumer in the European Union, the United Kingdom, Australia, or anywhere else with mandatory consumer guarantees, those guarantees apply to you regardless of anything in the two sections above, and where they conflict with the disclaimer or the liability limit, your statutory rights win.
Termination
You may stop using the Service and delete your account at any time from the app’s Settings. We may suspend or terminate your access if you violate these Terms. On termination, your data is handled as described in our Privacy Policy.
Governing law and disputes
These Terms are governed by the laws of the State of Kansas and the United States, without regard to conflict-of-law principles, and any dispute arising out of them or the Service will be heard in the state and federal courts located in Kansas.
If you are a consumer living outside the United States, this does not deprive you of the protection of the mandatory law of the country you live in, and it does not stop you bringing a claim in your local courts where that law gives you the right to. See Your rights as a consumer above.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and where the change is material we will ask you to accept the updated Terms in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
